Disciplinary Action by the Monitor

The Monitor has the authority and duty under the Consent Decree to bring disciplinary charges against individuals seeking to suspend or expel and debar the individual from the UAW, to fine or forfeit the individual’s benefits (with exceptions), or to otherwise discipline the individual, for certain types of misconduct as laid out in the Consent Decree.  Charges thus brought by the Monitor under the Consent Decree will be posted on this page after they are filed.  Disciplinary proceedings resulting from these charges are held before the Court-appointed Adjudications Officer.  Final orders by the Adjudications Officer will be posted on the Adjudications Officer’s website, available here. Stipulations entered into by the Monitor to resolve disciplinary charges or other remedial action against individuals will also be posted on this page.


Barred Persons under the Consent Decree

The Consent Decree prohibits the UAW and its constituent entities, the International Executive Board, and all current and future UAW members, officers, agents, employees, representatives, and persons holding positions of trust in the UAW and its constituent entities, from (a) knowingly associating with any “barred person” (with some exceptions) and (b) knowingly permitting any “barred person” from exercising any control or influence, directly or indirectly, in the conduct and affairs of the UAW and affiliated entities.

Under the Consent Decree, the following people are “barred persons”:

(a)  convicted individuals currently prohibited from serving in an office or employment by 29 U.S.C. § 504 or 29 U.S.C. § 1111;

(b)  individuals enjoined from serving in a prohibited position or employment with a labor organization, employer association, employee benefit plan, or as a consultant to such organizations;

(c)  individuals who are members of a criminal group designated by the Federal Bureau of Investigation;

(d)  the following named individuals:

  • Gary R. Jones

  • Dennis D. Williams

  • Joseph J. Ashton

  • Norwood H. Jewell

  • Vance R. Pearson

  • Michael X. Grimes

  • Edward N. Robinson

  • Jeffrey X. Pietrzyk

  • Nancy Johnson

  • Virdell King

  • Keith Mickens; and

(e)  any person designated as a “barred person” by the Monitor.  As discussed below, to date the Monitor has designated Timothy Edmunds, Danny Trull, and James Beardsley as “barred persons” under the Consent Decree.


Timothy Edmunds

On July 6, 2022, the Monitor filed charges with the Court-appointed Adjudications Officer against Timothy Edmunds, former Financial Secretary-Treasurer of UAW Local 412, after Edmunds pleaded guilty in federal court to embezzling approximately $2 million from UAW Local 412 between 2011 and 2021 in a scheme involving personal use of the UAW Local 412 debit card and transfer of funds from UAW Local 412 bank accounts to Edmunds’ personal accounts. The Monitor charged that Edmunds’ violations of federal law, the UAW Constitution, the UAW Ethical Practices Codes, and UAW Administrative Letters warranted disciplinary action. On July 26, 2022, Edmunds and the Monitor entered into a stipulation, wherein Edmunds agreed not to contest the facts constituting embezzlement and to be expelled and debarred from the Union.  On July 28, 2022, the Adjudications Officer ordered Edmunds permanently expelled and debarred from the UAW and the Monitor designated him as a “barred person” under Section 20(e) of the Consent Decree, pursuant to the stipulation between the Monitor and Edmunds.

Danny Trull

On July 18, 2022, the Monitor entered into a stipulation with former Region 5 Assistant Director Danny Trull in which Trull agreed not to contest the Monitor’s allegations regarding his participation in the embezzlement scheme related to master account arrangements with hotels for which Vance Pearson, Edward “Nick” Robinson, and Gary Jones were convicted, and to be expelled and debarred from the UAW.  On July 22, 2022, the Adjudications Officer ordered Trull permanently expelled and debarred from the UAW and the Monitor designated him as a “barred person” under Section 20(e) of the Consent Decree, pursuant to the stipulation between the Monitor and Trull.

James Beardsley

On November 7, 2023, the Monitor entered into a stipulation with former Administrative Assistant James Beardsley in connection with an investigation conducted by the Monitor, which found that Beardsley participated in the embezzlement scheme related to master account arrangements with hotels for which other UAW officials were convicted.  To resolve the Monitor’s investigation, pursuant to the stipulation Beardsley acknowledged that he had resigned his UAW membership and agreed to be designated as a “barred person” under Section 20(e) of the Consent Decree.
